All I can say is word of mouth can destroy a builder like that, so it would seem to be in his best interest to fix you up.
I've been shooting emails back and forth about stuff he's working on and I know he recently had a death in the family so he's been working on clearing out the backlog.
No excuse for your pedal not working after sending it in...but I'd wait and see what his next move is.

Absolutely!
I get the best parts possible, but occasionally a toggle fails or something...which is very frustrating...and even more frustrating if the customer goes and posts about it before I've gotten a chance to make things right.

Happened to me twice personally (I wont say who, but it's no one I'm a dealer for)...so I try very hard to make sure a pedal's fixed before I send it back out. But misdiagnoses happen.
Hopefully he takes care of the issue. Also, it seems to me that if you're charging high prices, you should include at least a 5-year warranty.

Good luck, I hope it works out for you. I've ogled over his pedals many times and for what it's worth I've heard nothing but good things about Mario in the past.
