I really don't think the cloning is what would predicate the suit. As was pointed out on page 1:

The real issue is the "tortious interference" (emailing distributors). I'm not a lawyer, and I'm not sure that said email would be a slam-dunk bit of evidence for a winning suit, but it's enough (I think) to get as far as a trial. At that point, the alleged tortfeasor (the one who committed the tortious act) has likely wasted a fair bit of money if he/she has retained an attorney. Or they could go cowboy and opt for a pro se defense (self-representation). This is often a good way to go for a suit you suspect is overtly frivolous or one that has damage claims of a low value.

If any of you are interested in becoming armchair amateur attorneys (like me), check out your state court's page on Pro Se law. New Jersey has a great page for this, including a very informative handbook on civil suit procedure (written for people who aren't attorneys):
