plus if he loses he may establish a legal precedent that kyping someone else's circuit is actionable, which not only opens up a yawning chasm under his business model but under large chunks of the whole pedal industry. it may be in a lot of folks' interests for this to go away quickly and quietly.

I really don't think the cloning is what would predicate the suit. As was pointed out on page 1:

Tortious interference with contract relations is, as you would expect, a tort. Mental distress can be included in damages. Contracts arising out of the interference can be enjoined to prevent the tortfeasor from benefitting.

The real issue is the "tortious interference" (emailing distributors). I'm not a lawyer, and I'm not sure that said email would be a slam-dunk bit of evidence for a winning suit, but it's enough (I think) to get as far as a trial. At that point, the alleged tortfeasor (the one who committed the tortious act) has likely wasted a fair bit of money if he/she has retained an attorney. Or they could go cowboy and opt for a pro se defense (self-representation). This is often a good way to go for a suit you suspect is overtly frivolous or one that has damage claims of a low value.
