Eventide offered to allow me to upgrade my account but not my unit. This would me if I ever sell it again, I will not be able to sell it as a Max, but as a regular H9. So in a way that's a solution. Not the exact one I wanted, but it's a solution. Otherwise I can return it and buy the max which would be pretty pointless and cost me the same in shipping probably as the savings I would achieve.
They also said I'll receive all future algo's, but they will have to be manually entered from Eventide instead of automatically like all other Max owners.
What would you guys do?

Here's the deal. Its unusual for a company to allow you to resell DRM content at all. I hate DRM, and Eventide's policy of allowing you to resell it, even if only once, is far from typical and I would say generous in comparison to 99% of the DRM world.
I would say it is dastardly of them to not mention that you can only max out once, but by April 1st it will be moot, since the minimum number of algorithms will go up to a point where participating in the max out program twice will be so close to buying every algorithm that it won't matter. If it was me dealing with them I would stick hard to the point that it doesn't say anywhere that you can only max once.
Almost every other digital distribution system out there doesn't let you legally resell the stuff you've bought and paid for even once. I'm not saying Eventide are the good guys, they are just a tiny bit nicer than the really bad guys that most of the world seems to love; Steam, iTunes, Amazon Instant Video, Google Play, etc.

There's no way I'll win on that though. I know that already. They would rather me not be their customer. haha. I mean I want the pedal, I have the pedal now, makes no sense not to use it to it's fullest. My only conflict is whether or not I keep the unit I have or return it for a "true" max.

Well if they are upgrading you for free I would take them up on it. Even if you can't resell it as a Max. It comes down to whether getting free future algorithms without dealing with Eventide CS is worth $200 to you.

The verbiage that they use is just down right nasty. It seems to imply that the "purchases" stay with the account. "As always, you may share effect algorithms with up to 5 devices registered to you. The good news is you only need to upgrade one device. The better news is you pay the lower of the upgrade prices if you have both an H9 and H9 CORE. (In this instance, your H9 would be upgraded.)"
So the fucked up part is that they do not clarify that you MUST KEEP THE FUCKING DEVICE because nothing is tied to your account after that?
It's just a lot of double speak. "Hey, here's all this awesome shit you can do if you spend $500 on a digital pedal and a bunch more on Algorithms for it. BUT DON'T YOU EVER SELL THAT DEVICE YOU SNAKE-BASTARD OR WE WILL NICKLE AND DIME YOU FOR EVERY PENNY."
I understand what being a company is all about but the language just isn't there to make you truly understand the ins-and-outs of this program. For instance... take the iPhone 5 Battery Replacement Program that Apple put out.
It goes on to say...If your iPhone 5 is experiencing these symptoms and meets the eligibility requirements noted below, Apple will replace your iPhone 5 battery, free of charge.
So before you take your ass into the Apple store you can say, "well fuck me I'm the dumb shit who dropped his/her phone and broke it all to fuck," and you're at least in the know that something might happen. Eventide doesn't seem to offer any of that information based on what JWAR posted.Note: If your iPhone 5 has any damage such as a cracked screen which impairs the replacement of the battery, that issue will need to be resolved prior to the battery replacement. In some cases, there may be a cost associated with the repair.
My take on the whole thing is to just tell Eventide to frigggggg off. It seems like a lot of work to be doing constantly to get what you want of this fucking thing. But what do I know, I've never used a single Eventide product and couldn't tell you if they're really worth a goddamn. I'm just not all that impressed with the customer service they provided.
I don't think anybody should ever throw a fit with customer service representatives but instead should contact them using rational and logical expressions and arguments (without being argumentative) and explain why they should want to do the things that you're asking them to do. Eventide wasn't clear enough in its language when it talked about this maxed out H9 stuff and as a result they should offer to own up to their mistakes. But the language is so convoluted you have to wonder how they didn't see this type of thing coming. Here's a company trying to do something ahead of the curves but they've got their heads so far up their own creative asses that they didn't stop to think about how some of this stuff was going to pan out.

I'd return the H9 and never look back. If a company gives me any attitude or the impression I'm unimportant to them as a customer, their products and services immediately become toxic. I will go out of my way to avoid supporting and/or dealing with any such business in the future.
With today's options, it's beneath me to accommodate such a relationship.
