basically this. the main point there is reserving rights to manufacture something based on the core -- it's like having your cake and eating it too. doesn't make sense.
obviously it's easy enough to buy/borrow a unit, trace it and clone it. it's entirely another thing to have the backing of the original builder/creator and be able to use their name. it's not a terrible deal if you look at it from a big picture POV of making lots of units, but really it's a lot of money to drop on a risky investment and 5 years is a long period to be sharing in profits. i think it would have been wiser to work out some sort of a partnership with someone, take a larger % per pedal with a cap on the total and do away with the manufacturing clause.

Yea I agree. I'm assuming Malekko did this with Wolftone for the Chaos and Helium.
But the thing is... This dude knows what he has and what it's worth and he's gonna exploit it until the very last drop. Kinda sad. Someone just needs to make a better version of one!!
Yeah, but why wouldn't he just continue to sell them himself at $400-600 a piece? Even if he paid someone else to assemble them it would be way more profitable in the long run.

I would have expected "I will not produce these for five years" non-compete, not "I get what the likely profit per unit amounts to and you build it and pay me for the privilege."

Seriously his offer is bullshit. I wonder if he's hoping for some chinese brand like Mooer to jump on it. But wouldn't he have to be advertising this in a way bigger style then? Don't get me wrong I would like to see these get back in production and it'd be best if they were cheap too. The only way this would work out for the buyer is if it's a big company that can just flood the market with cheap product, sold and marketed worldwide. 4.000 is not much from the perspective of a company that big. But I guess the 5% might kill that option. The cheaper you sell, the less your revenue span will be, obviously. Having to shell out 5% to a designer might just be the dealbreaker.
without going into too many details, my offer was for no money up front but a larger percentage of net sales which tapers off with the number of pedals sold. my interests are in making it more guitar/instrument friendly and cheaper. i'd probably be looking at putting it into the newer vertical layouts with 2 stomps...
either way it's moot. i doubt he's going to be interested.
