I see lots of people using public domain art for flyers and stuff, but that's relatively non-commercial compared to a pedal company doing it. There's no mention of the artist on the Red Witch website? Even that would be something...
Personally I stay away from pedals that swipe art and if it's so incredible that I have to have that sound I'd pay the extra to re-house it. No Simpsons themed pedals, no pink panther bullshit, etc... But I'm a designer so getting ripped off hits close to home.

It gives off strong Foxx Tone Machine vibes so that might be why.
Before I even read the description I thought Tone Machine and then the hilarious advertising mentioning 4 diodes and "unlike anything they've ever made".
...so yeah, $300 for another tone machine, no thanks. Looks nice though. Maybe they are paying royalties for the art they don't credit

If it's public domain I don't see the issue. Its highly likely that this image was found in one of those Dover books full of royalty free images, they have a ton of Art Nouveau ones out. Its pretty common to have uncredited stuff in those books. Sometimes, the credit is in some giant index in the back of the book but not always.
