They can't tell from scrobbles whether or not you have bought the music or not. You can even listen to music free on Last.fm.
So really, it's all a load of bollocks.
While this is true, it's more of a matter of personal privacy. If this is true, the RIAA has once again invaded the privacy of millions of people for their own agenda. It's the principle of the matter.
And the only real possible threat here is to users who have downloaded leaked albums that are yet to be released. Do scrobbles record the specific time the song was played? If it does, that's trouble for those users. Otherwise, there's no real way the RIAA(or last.fm/CBS, for that matter) could tell the users didn't start listening to the album after it was released.
It seems incredibly difficult to be caught pirating under these circumstances.

so, in theory, the riaa could know that you listen to free legal music on lastfm, and where your computer is. Just like ummm, any site you go to can see your IP and know where your computer is, what browser you use, and what OS you use?
THOSE BASTARDS. or is there somehting Im missing?
