Could be wrong, but I think Tosh just used a Cry Baby.

I don't think so. It's cycling up and down in a way that is way too regular to be someone's foot, it sounds like an almost perfect sine wave. My bet is a phaser. Since this is 1973, it was probably the Maestro, I don't know what else was out yet at that point. Not sure if Mutron was around yet.

sounds like a wah to me, with the guitar/amp tone quite spiky already, bass rolled off, so when the wah is down-wah its kind of losing all tone together

Well, I think he's got the phaser on the whole time and just steps on the wah for the solo.

Those were my thoughts too.

INTERESTING. I would've never thought of that, but that makes sense.
So, what wahs do you guys like? Or what wah would you guys recommend for me to get all Peter Tosh-like?

The other possibility is that they played to a pre-recorded track and it's not even a guitar solo at all.
It kinda sounds like it might be a Clavinet through a wah wah.
Does anyone know if Old Grey Whistle Test performances were live?

OK, I just listened again.
It sounds like Tosh starts out the solo and then the Clavinet comes in and picks it up.
So, I'm not sure what M_B is actually wondering about.

Are we saying that the clavinet is doubling what he's playing then?

I don't know if I'd say the Clavinet is doubling, but seems to come in and out during Tosh's guitar solo. At times it's almost more Clavinet than guitar.
I think the really resonant percussive stuff you're hearing is from the Clavinet.
They're playing along together. It's a little deceiving that the camera stays on Tosh. When they cut to the keyboard player at @3:30, you can see he's got his right hand on the Clavinet. Audio sync seems to be just a bit off. Hope this helps. Maybe you wanna Clavinet?
