So Eventide's Rose pedal is the glitchy thing they teased 2 years ago in a video. That's some straight up Montreal Assembly bullshit.

Maybe Scoot should send them a C&D.

Jwar wrote:Am I missing something here? Their trademark only refers to digital. How does this make any sense. Also, Eventide, you’re a bunch of dick heads. You start a conversation first and send a cease and desist if you cannot resolve the issue. What you are doing is backward but I’m not surprised given asswipes you’ve been in the past.

A C&D is the first step in the process. It is intended to avoid legal action but it the first step in the event that you get to legal action down the road. You have to defend your trademark and document defense.

It’s the first step in the process if you’re an asshole at business but other than that, sure you’re right.

Btw. They trademarked something that is probably unknown. Most people aren’t going to do a trademark search on a guitar pedal. The defensibility of the name is in the brand. If it’s not, well then they have bigger issues to address.

Silver Rose, 2011. Fuck you, Eventide.

It'd be hilarious if Dwarfcraft had an older trademark and C&D'd Eventide.

And here's the video they mention:

Well, it'd be sweet if the conversation that follows leads them to kindly piss off and let Tom keep doing his thing as planned. I see no reason why there would be any conflict—it's like when Handsome Dick Manitoba sued Caribou (then also called Manitoba) over "potential confusion" or some bullshit. I don't think anyone would have that problem.
Anyway, picked up a BR today. Stoked. Hope this all causes Tom the minimal possible hassle.

Reading through the TGP thread, it seems that Tom's already made up his mind to get a new name and a solidified trademark.
Also, I guess he actually applied for a trademark for Rose Pedals in July, when he started, but then Eventide got their trademark for "Rose" confirmed in August, so he's pretty well fucked without a team of lawyers.
It's dumb and it's exactly the kind of bullshit that big pedal companies pull (like EHX and the word "muff").

This kerfluffle didn't get very much traction on Twitter, but I did tweet at Vernon Reid trying to get attention for Tom's cause. Regardless of the outcome, I was proud of this particular enjambment and don't want it to go to waste:

Company claiming their legal rights? Fuck'em.
Also let me know if you guys want to get rid of your Eventides for cheap, specifically Orville or DSP7000.
