Here's my thoughts. I would use your video as leverage. Tell him you'll pull the video if he issues you a refund. He won't save face here, but at least you won't do further damage to his rep elsewhere.

If he's not willing to issue a refund, then he's an idiot and should be dealt with accordingly. Seriously. Learn to run your business right or don't run one. You can't please every customer, but as a small business you sure can fucking try.

Funny how after paypal closes the case he admits the pedal is fucked up, i'd at least send that interacton to paypal. Not really in hopes of getting it reversed, more of a "see you suck at what you do as well paypal"

From what I've read so far, I predict he won't offer a full refund inc shipping costs.

This is pretty much standard for any company when you want to return something... and the 30% deduction from the amount paid is normally considered a "re-stock" fee, or "re-fund" fee and the reason for this is mostly because the seller/company can't tell whether the item has been damaged, or whether the item was damaged in transit... So this is basically in place so that we are not losing money every time a return is made and also for the hassle of fixing the pedal (time/money), and re-shipping the pedal (time/money).

Anyway, sorry for the lecture, just wanted to clear that up... let me know if you want to return it, or if you have any other questions/comments, please let me know."

sooooo.... all morning i've been thinking about this, and it feels weird sending out an admittedly broken pedal to have people "demo" how awful it sounds. i don't know how honest that is, and just because someone is being an ass to me, i don't know if that means i want to stoop to their level and be an ass back.

.... but then i reread the emails and think about how he didn't admit it was broken until AFTER PayPal sided with him and how he never had any refund/30% off bullshit anywhere on his site until all this went down.....

Fuck him. Seriously. He sent out a broken pedal. That's his fault, not yours. He has absolutely NO logical reason to back up the fact that he can't, or shouldn't, give you a full refund. Upon purchasing the pedal you both entered an agreement. You agreed to give him an amount of money. He agreed to give you a properly functioning pedal. Through whatever circumstances he failed to live up to his side of the agreement.

I seriously think he fails to see the difference between selling someone a faulty product and someone returning something because it turns out they just don't like it.

He sent you a broken pedal and he wants to charge YOU $40 to fix it so he can re-sell it?



If this guy think fixing and shipping a pedal is a hassle, he needs to seriously consider a new line of work.
