If it is, couldn't dwarfcraft stop paying royalties to her? :?:
Yeah that's what I was thinking. If Devi is making pedals that is a breach of the non-compete contract. If it were me I would withhold royalties. :idk:
Seems to me she is living quite comfortable off the money suckers are giving her on gofundme. Maybe Dwarfcraft should start a "need money to sue Devi for breach of contract" crowdfunder. I'll kick in.

It's probably just better for DC to stick with the contract. If anything, that just shows what good people they are compared to Devi.

Now that is an interesting thought. If she breached the contract then DC doesn't need to uphold their end of it anymore.
I don't think they'd stop though because they have stated they just want to get their investment back and wind things down to distance thenselves from the drama.

It's obvious from her words that Devi has no respect for the contract she willingly signed and feels no obligation to abide by it. Sure she isn't using the old model names and graphics but is offering the circuits and is essentially saying "based on this old design".
So while perhaps not an explicit violation she certainly feels entitled to push the envelope as far as can be.

This is a very impressive collection of Roto Toms. That's 21 Roto Toms in all. That is only $33.00 a Roto Tom.

Would the tone be in the bun or the frankfurt? Or perhaps the mustard!

When I was in high school, I went to a Spin Doctors concert. I was personally only there to see the Screaming Trees, but the Spin Doctors were headlining. Anyway, right when the gates opened, the bass player and drummer were hanging out at this grassy area where backstage goes right up to the lawn. The drummer was a mensch btw; one of my friends got her camera batteries confiscated by security and dude rode away on his mountain bike and came back with a HUGE ziplock full of AA batteries all like "take what you need."

But mostly I remember this exchange between the bassist and some kid who was grilling him about his gear:
Kid: What kind of bass do you use?
Bassist: Cheeseburger
Kid: What kind of strings do you use?
Bassist: French friiiiiiies.

Making it not really an option.
That's a bit of a different issue than what Devi's financial situation situation is, but it's another "it depends" type issue.
Is there enough value to warrant going to the warchest to protect the interest?
and that's just a judgement call and you have to weight it against what the litigation/arbitration will actully cost. A lot of people just stall at "eek...litigation" and never look into it beyond that (pro bono, slinding scle, legal clinics for small biz, etc etc).
Litigation can be costly, and attornies sometimes get a bad name because people are so averse to employing legal help early that they get themselves into trouble later -- but by the same token people just balk and never pursue their legal options. and that's where the small time scammers and ne'er do wells live and breath

I'm still shocked the kickstarter folks never got a clas action together.
I mean it's not "ganging up" it's actually more like parity. It's sort of the opposite of ganging up since it consolidates the issue into a single case

What would happen if we coated the inside of a bathysphere in mustard and put Devi in it? Would that solve the problem?
